Terms of Service

These Terms of Service ("Terms") govern your use of Lemmy Go, a service of Weiscoast LLC ("Lemmy Go," "we," "us," or "our"). By using lemmygo.com, scheduling a call, or purchasing a Lemmy Go service, you agree to these Terms.

The Lemmy Go Service

Lemmy Go allows customers to request a scheduled automated phone call to a phone number they provide. The service is intended to provide a convenient reason to step away from a date, meeting, conversation, social gathering, or similar situation.

You choose the requested call time and provide the information needed to place the call. If you separately opt in to SMS messaging, Lemmy Go may also provide limited transactional text messaging related to your scheduled call, including the option to request one retry if the scheduled call goes to voicemail.

Not an Emergency or Safety Service

Lemmy Go is not an emergency service, security service, medical service, crisis service, law-enforcement service, or personal safety monitoring service.

You should not rely on Lemmy Go to protect you from danger, prevent harm, summon emergency assistance, verify your safety, or contact authorities or another person on your behalf.

If you believe you are in immediate danger or need emergency assistance, contact the appropriate emergency services directly.

Scheduling and Call Timing

We make reasonable efforts to place your call at the scheduled time you select. However, telephone networks, internet services, third-party providers, device settings, carrier filtering, service outages, technical delays, and other circumstances may affect whether or when a call is delivered.

Accordingly, we do not guarantee that every call will arrive at the exact second requested or that every call or text message will successfully reach your device.

Scheduled times must satisfy any minimum lead-time requirements displayed during checkout or scheduling. We may reject, cancel, or refund a request that cannot reasonably be scheduled in time.

Phone Numbers and Authorization

You may only provide a phone number that you own, control, or are otherwise authorized to use for the Lemmy Go service.

By submitting a phone number and scheduling a call, you authorize Lemmy Go and its service providers to place the requested telephone call to that number.

SMS messaging is optional and requires separate consent. If you opt in to SMS messaging when scheduling a call, you authorize Lemmy Go and its service providers to send transactional text messages related to that scheduled call, including a message offering the option to retry the call once if the scheduled call goes to voicemail.

Message frequency varies based on your use of the service. Message and data rates may apply. You may reply STOP to opt out or HELP for help. SMS consent is not a condition of purchase.

You are responsible for entering accurate contact and scheduling information.

Payments

Prices are displayed before you complete your purchase. Payment is processed by Stripe or another payment provider we may use in the future.

You authorize the applicable payment processor to charge the amount shown at checkout using the payment method you provide.

Unless otherwise stated, each purchase covers the specific scheduled call or service described at checkout and does not create a subscription.

Refunds and Service Failures

Scheduled calls may be rescheduled or cancelled until 5 minutes before the scheduled call time. Once a call enters that 5-minute window, it is locked in and customer-requested changes, rescheduling, and cancellation are no longer available.

The 5-minute lock does not affect any refund, credit, or other remedy that may apply if Lemmy Go fails to provide the purchased service because of a qualifying failure on our side.

If Lemmy Go is unable to schedule or initiate a purchased call because of a qualifying technical or scheduling failure on our side, we may automatically issue a refund.

Refunds may also be issued when payment completes too late for the requested call to be scheduled within required timing limits.

Call credits purchased as part of a bundle do not expire. A bundle purchase may be refunded within 60 days of purchase if your account has at least the number of available call credits originally included in that bundle. A bundle refund removes that number of credits from your account and refunds the amount originally paid for that bundle. Bundle refunds must be for the entire bundle; partial bundle refunds are not available.

If a scheduled call paid for with a call credit is cancelled in circumstances that qualify for a return of that credit, the credit is restored to your account rather than refunded as cash.

A call that reaches voicemail, is declined, is not answered, is blocked by a carrier or device, or cannot be completed because of incorrect information supplied by the customer does not necessarily qualify for a refund.

Any refund is returned through the original payment method and may take additional time to appear depending on your bank or payment provider.

Acceptable Use

You agree not to use Lemmy Go to harass, threaten, stalk, intimidate, defraud, impersonate, deceive for unlawful purposes, or repeatedly contact another person without authorization.

You may not use the service to facilitate illegal activity, interfere with telecommunications systems, evade legal restrictions, transmit malicious content, or otherwise misuse the service.

We may refuse, cancel, suspend, or restrict service when we reasonably believe Lemmy Go is being abused or used unlawfully.

Third-Party Services

Lemmy Go depends on third-party providers, including telephone carriers, Twilio, Stripe, Supabase, Vercel, Google, and other infrastructure and technology providers.

Their systems may experience outages, delays, filtering, interruptions, or other issues outside our direct control.

Service Availability and Changes

We may modify, suspend, restrict, or discontinue any part of Lemmy Go at any time. We may also change prices, features, scheduling requirements, or service functionality for future purchases.

Changes will not alter the amount already charged for a completed purchase unless a refund or other adjustment is issued.

Disclaimer of Warranties

To the fullest extent permitted by law, Lemmy Go is provided on an "as is" and "as available" basis. We do not guarantee uninterrupted service, error-free operation, successful telephone delivery, or that the service will produce a particular social or personal outcome.

Limitation of Liability

To the fullest extent permitted by applicable law, Weiscoast LLC and its owners, employees, contractors, and service providers will not be liable for indirect, incidental, special, consequential, or punitive damages arising from or related to your use of Lemmy Go.

To the fullest extent permitted by law, our aggregate liability arising from a particular Lemmy Go transaction will not exceed the amount you paid us for the service giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless Weiscoast LLC from claims, losses, liabilities, and expenses arising from your unlawful misuse of Lemmy Go, your violation of these Terms, or your use of a phone number that you were not authorized to use.

Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Changes to These Terms

We may update these Terms from time to time. The updated version will be posted on this page with a revised effective date. Continued use of Lemmy Go after updated Terms take effect constitutes acceptance of those updated Terms to the extent permitted by law.
